People assume Joshua Tree must be a town because the park is named after it and because Yucca Valley is one. It is not. Joshua Tree is an unincorporated community, and so are Yucca Mesa, Flamingo Heights, Landers and most of Pioneertown. Every one of those addresses falls under San Bernardino County Chapter 84.28, not under any municipal code. Drive a few minutes west and you are inside the Town of Yucca Valley, where the County chapter does not apply at all. Drive east and Twentynine Palms has its own licence.
This is not a technicality. Applying the wrong authority's answer is how owners end up advertising a property that has no valid permit, which both the County and the City treat as a violation in its own right.
Chapter 84.28 governs short-term residential rentals in the County's Mountain and Desert Regions, defined around stays of 30 consecutive calendar days or less. A permit is required before you advertise or rent. It lasts a year, is renewed with reinspection, and does not transfer when the house is sold.
If you already hold two County permits, a third unincorporated property is not a hard application. It is ineligible. That is worth establishing before an offer, not after a renovation.
Applications themselves are open: the County program page states that applications are currently accepted for dwellings in the Mountain and Desert areas of San Bernardino County. We also read Chapter 84.28 in the current code edition and found no separation or minimum-distance standard between rentals, no density limit by community, and no moratorium.
The Town states that it currently regulates short-term vacation rentals under Ordinance 312, and that the permits required to rent a single-family dwelling short term are obtained through the Town Planning Department. Business registration and transient occupancy tax run through Town Finance, which makes them separate steps rather than part of the planning permit. The Town does not publish a cap, a separation standard or an application-window status on that page, so confirm the current position for your address directly with the Town.
The City licenses Vacation Home Rentals: a detached single-family dwelling, or part of one, let for a minimum of two consecutive nights and no more than 30 consecutive calendar days. Note the floor as well as the ceiling — one-night stays are outside the definition.
It is illegal to operate, list or advertise before the City has issued both a VHR licence and a business licence. Licences do not transfer on sale: the existing one terminates and the buyer applies afresh. Building permits for any remodel must be signed off by the City Building Inspector before a VHR safety inspection can be called, and unpermitted work will delay approval. Quiet hours run 10:00 p.m. to 7:00 a.m., overnight parking must never exceed available on-site spaces, and transient occupancy tax sits under Municipal Code Chapter 3.24. The City also notes that its Council recently approved a modification of the previous VHR ordinance, so check the date on whichever copy of Chapter 19.41 you are reading.
A County permit, a Town permit or a City licence says the public authority is satisfied. It says nothing about your CC&Rs. Private restrictions can be stricter, up to and including an outright prohibition, and they are enforced by a different party with different remedies. Get the recorded documents, get a written association determination where one exists, and put them in the property file before you market the home. Road-maintenance agreements, easements and septic or water covenants belong in the same file.
It does not establish your parcel's zoning, legal dwelling status, permit availability, inspection outcome, tax registration, septic or water capacity, road access or fire requirements, and it quotes no fee amounts because none was read from an official source during this review. Use the street address and parcel number to get current confirmation from the correct authority before representing the home as eligible.

Two. Chapter 84.28 provides that a short-term rental owner is not eligible for more than two County STR permits, alongside a per-parcel limit of one permit under 2 acres and two at 2 acres or more. Owners who already exceeded the owner limit when the ordinance took effect may renew as a legal non-conforming use.
No. A public permit and a private restriction are separate. CC&Rs, deed restrictions and association rules can be stricter, including prohibiting the use entirely, and they are enforced separately. Review the recorded documents and obtain a written determination before marketing.
